What is a party's admission in civil law?

A party's admission in civil law is a statement or document on behalf of one of the parties that constitutes an admission of some matter in the case.

We will illustrate this with an example: There is a financial dispute between Shalom and Moshe that has reached court. Shalom claims in the context of Claim submitted on his behalf that he gave Moshe a loan of one million shekels. As part of Defense The case was filed on behalf of Moshe, but it was denied and it was claimed that this was not true. The court proceedings continued and the parties reached the evidentiary hearing, during which Moshe was questioned about his claims. Suddenly, Moshe admitted at the hearing that he had received one million shekels from Salam. This admission is a confession by a litigant.

According to the same example, it would also be possible to obtain a party's admission in another way - for example, if Shalom were to present correspondence with Moshe in which Moshe wrote and confirmed that he had indeed received the funds.

In other words, it is important to understand that the issue of a party's admission in civil law is not only relevant to oral statements but also to written documents, and that a party's admission can be a statement made during a court hearing or outside the courtroom.

בעניין זה בית המשפט העליון קבע כך (ע"א 7003/99 מרינה ראמי נ' סהר חברה לביטוח, פסק דין מיום 8.11.2001):

The appellant's words are tantamount to a confession by a litigant outside the walls of the court. Evidence regarding a party's confession may be presented outside the courtroom as an exception to the rule prohibiting the admission of HearsayIn criminal trials, evidence is also presented of what a defendant said outside the courtroom as an exception to the rule prohibiting hearsay testimony.

A confession by a litigant outside the courtroom is not perceived as a formal confession, but rather is evidence among other evidence that the opposing litigant can rely on. (למשל, ע"א 279/89 "הסנה" חברה ישראלית לביטוח בע"מ נ' דמתי [1]). המערער, שטען טענת "היעדר זיכרון", ממילא לא הכחיש את אמירת הדברים. הוא לא חשף עצמו לחקירה עליהם. הוא גם לא נתן לדברים הסבר כלשהו. הדברים עומדים אפוא כפשוטם ומדברים בעד עצמם.

Is it possible to retract a statement or document that constitutes a party's admission?

Sometimes a situation arises in which a party wishes to retract a statement. If we return to our example – let’s say Moshe wants to retract his confession in a hearing that he received a million shekels in payment. A party’s confession can be retracted, but things must be done in accordance with the rules established by the Supreme Court ruling.

בעניין זה בית המשפט העליון פסק כך (רע"א 3487/13 אחמד נעימה נ' ד"ר יהודית מנליס, פסק דין מיום 10.6.2013):

שנית, בית המשפט המחוזי הסיק קיומה של הודאת בעל דין בהסתמך על כתב ההגנה המקורי מטעם המבקשים (ואליאס), ועל ראיות נוספות. המבקשים טוענים (סעיף 31 לבקשה), כי גם אם ניתן להסיק קיומה של הודאת בעל דין ממסמכים אלה, הנה בית משפט השלום התיר להם לחזור מהודאתם, בהתאם לתקנה 104 לתקנות סדר הדין האזרחי, תשמ"ד-1984. נטען, כי "כתב ההגנה המתוקן ברור לחלוטין ולא ניתן לטעון בגינו כי קיימת הודאת בעל דין".

גם בסוגיה זו לא נמצא מקום להתערבות בפסק דינו של בית המשפט המחוזי (אשר ביטל את קביעתו של בית משפט השלום – פסקה י"ט לפסק דינו). תקנה 104 מאפשרת לבית המשפט להתיר לבעל דין לחזור בו מהודאתו. ואולם, על בתי המשפט לנקוט זהירות מרובה בעשיית שימוש בשיקול דעתם לאפשר חזרה מהודאה. וכבר נאמר, כי על הטוען לחזרה מהודאה לשכנע "את בית המשפט בעדות או בתצהיר כי ההודאה נתנה בטעות או מתוך תרמית או שלא מרצון חפשי, או לא מדעת, או שתכנה אינו אמת" (ע"א 375/84 עדן נ' אל פאגורי, פ"ד מב(4) 226, 238 מפי השופטת נתניהו).

ועוד נאמר שם, בעמ' 239, כי "ההסתמכות על ההוראה הדיונית המאפשרת לנתבע לתקן את הגנתו ללא נטילת רשות בעקבות תיקון כתב התביעה, אין בכוחה לגבור על הדין המהותי החולש על כוחה של הודאה ועל הצורך ברשות בית המשפט לחזרה ממנה". הנה, גם אם נצא מתוך הנחה כי בכתב ההגנה המתוקן העלו המבקשים טענות שונות מן הנטען בכתב ההגנה המקורי, לא היה בכך כדי להצדיק את חזרתם מהודאה.

האם כל אמירה "לא טובה" היא בגדר הודאת בעל דין במשפט אזרחי?

חשוב להבין שלא כל אמירה "לא טובה" שאמר בעל הדין מחוץ לכותלי בית המשפט היא בגדר הודאת בעל דין. לעיתים הדברים נאמרו כתוצאה מטעות או מהבנה שגויה של המציאות. אין זה אומר שמתעלמים מאמירה זו, אלא שמתייחסים אליה לעוד ראיה שעל בית המשפט יהיה לדון בה ולהכריע לגביה.

בעניין זה בית המשפט העליון קבע כך (ע"א 279/89 הסנה חברה ישראלית לביטוח נ' שלום דמתי, פסק דין מיום 27.6.1993):

It is a settled law, That not every statement by a litigant of his own obligation, in a matter in dispute in the trial, is tantamount to an admission (בעובדה או בזכות) שבעל הדין נתפס עליה. אבן הבוחן המסורתית היא, שרק הודאה "פורמאלית" (או "משפטית"), הנכללת בכתבי הטענות או הנמסרת בגדר הליך דיוני המיועד לכך (כגון: בתשובה לדרישה להודות בעובדות או בהצהרה מפורשת במהלך הדיון), מובילה לצמצום המחלוקת ופוטרת את בעל הדין שכנגד מהבאת ראיות להוכחת עמדתו בנושא ההודאה.

מהודאה כזאת אין בעל דין רשאי לחזור בו, אלא ברשות בית המשפט ובתנאים שיקבע לכך (תקנה 104 לתקנות סדר הדין האזרחי, תשמ"ד-1984). רשות כזאת עשויה, לרוב, להינתן על יסוד הטענה שההודאה נעשתה בטעות (ראה י זוסמן, סדרי הדין האזרחי (אמינון, מהדורה 6, בעריכת ש לוין, 1990) 430). כן עשויה להישמע (אם תיאמן) הטענה, "כי ההודאה ניתנה בטעות או מתוך תרמית או שלא מרצון חופשי או לא מדעת, או שתוכנה אינו אמת" (כלשון השופטת נתניהו בע"א 375/84 ד' עדן בשם עיזבון המנוח א' עדן ז"ל נ' מ' אל פאגורי ואח' [1], בעמ' 238).

התבטאות אחרת של בעל דין, לרבות עדותו שתוכנה מנוגד לעניינו או תומך בצדקת עמדתו של בעל הדין היריב, אינה נתפסת כהודאה "פורמאלית", אלא (כביטויו של השופט הלוי בע"א 211/63 יחזקאל נ' א' קלפר ואח' [2], בעמ' 572) כ"ראיה כשאר הראיות ובין שאר הראיות", שבידי בעל הדין היריב להסתמך עליה (ראה א' הרנון, דיני ראיות (המכון למחקרי חקיקה ולמשפט השוואתי על שם הרי סאקר, כרך ב, תשל"ז) 59, וסיכומו של השופט גולדברג בע"א 728/81 חלבי נ' עיזבון המנוח מועין חלבי ואח' [3], בעמ' 482).

משמעות הדבר היא, שאם הובאו במשפט גם ראיות אחרות, התומכות בעניינו של בעל ההודאה (אף כי שונות הן מעדותו שלו או אף סותרות אותה), בידי בית המשפט, אם שוכנע באמיתותן, להעדיפן על פני עדותו (ראה: ע"א 211/63 [2] הנ"ל, בעמ 573ואילך; דברי השופט (לימים הנשיא) י כהן בע"א 724/70, 737חמדאן נ' יוסף ואח' וערעור שכנגד [4], בעמ' 788).

In conclusion

A party's admission may be a statement made outside the courtroom, during a court hearing, or a statement written in the pleadings of one of the parties. It is usually an admission of some claim by the opposing party, which makes it unnecessary for the opposing party to prove it (because in light of the admission, the matter is no longer in dispute).

Not every confession will be accepted as a confession by a party, and sometimes a party's statement on a matter that is acting on his own behalf will serve as one piece of evidence among all the evidence that the court will have to discuss and decide.

In very exceptional cases, a party may request to withdraw his confession and the court may grant such a request.

Frequently asked questions regarding the admission of a party

  • Is every admission of any claim by the opposing party an admission by a litigant?

    Generally, if the admission was made during the court hearing or as part of the pleadings, it will be considered a party's admission.
    If the confession was made outside the courtroom, the situation is different.

  • Is a litigant allowed to retract his confession in court?

    Yes, but in very exceptional cases.
    A written request must be submitted in this matter and explain why the confession was made in the first place and why the party wishes to withdraw the confession.

  • Is a confession by a litigant just an oral confession?

  • In a situation where a confession has been made about a matter, is it not possible to win the lawsuit?

    As far as a substantive matter is concerned, right at the heart of the matter, it will be very difficult to win a lawsuit in which the litigant has admitted to some issue, and certainly if the matter does not support his claims.
