What is judicial silence?
Judicial estoppel is a legal claim intended to prevent a litigant, or a party related to him, from asserting opposite or different claims in two different legal proceedings.
For example: If a party to a lawsuit claimed that he received funds, that party, or a party related to him, will not be able to claim that he did not receive funds, because there is a judicial estoppel.
Of course, it is very important to know the claim and actually raise it before the judge hearing the case. If the claim of judicial estoppel is not raised by the interested party, the judge may not raise this claim on his own initiative, and in practice it will be possible to continue the trial when one of the parties raises a claim completely opposite to a previous claim.
A claim regarding judicial silence can be raised in any proceeding (for example: Class action lawsuit, Civil lawsuit, Financial claim, Tort claim, etc.).

What does the court ruling on the issue of judicial silence state?
There are many rulings on the issue of judicial silence issued by Supreme CourtIt is important to focus specifically on the Supreme Court's ruling because it binds the other courts (a ruling by the Magistrate's or District Court is only a guide, and does not bind other courts).

As is known, the rule of judicial estoppel prevents a litigant from raising contradictory claims in different proceedings, even when the litigant in the two proceedings is not the same. (ראו: ע"א 513/89 Interlego A/S נ' Exin-Lines Bros. S.A, פ"ד מח(4) 133, 196 (1994)). This rule is intended, essentially, to maintain the purity of the judicial process and public confidence in the legal system. (ראו: רע"א 4224/04 בית ששון בע"מ נ' שיכון עובדים והשקעות בע"מ, פ"ד נט(6) 625, פס' 9 לפסק דינו של השופט גרוניס (2005)).
This purpose has two aspects: from a moral perspective, the rule focuses on the good faith of the parties and is intended to prevent Abuse of the judicial process; In practical terms, the rule seeks to prevent conflicting decisions by different tribunals (ראו, למשל: ע"א 1445/11 מרטינז נ' רילוב, פס' 24 [פורסם בנבו] (26.12.2012); ע"א 6181/08 וינוקור נ' ממונה מס ערך מוסף עכו, פס' 10 [פורסם בנבו] (28.8.2012)).
בעבר, תחולתו של כלל ההשתק השיפוטי הותנתה בכך שטענתו הרלוונטית של בעל הדין התקבלה במסגרת ההליך האחר (ראו, למשל: רע"א 6753/96 מ.מ.ח.ת. בע"מ נ' פרידמן, פ"ד נ(5) 418, 422 (1997)). במרוצת השנים רוכך תנאי זה, לכדי דרישה שלבעל הדין צמחה "הנאה" כלשהי כתוצאה מהעלאת הטענה שעל הפרק (ראו: עניין בית ששון, בפס' 11 לפסק דינו של השופט גרוניס; בר"מ 8689/14 הוועדה המקומית לתכנון ובניה מגדל העמק נ' מבני תעשיה בע"מ, פס' 14-11 לפסק דינו של השופט פוגלמן [פורסם בנבו] (4.5.2015));
ואף ביחס לנחיצותה של דרישה מרוככת זו ניתן למצוא עמדות שונות בפסיקתו של בית משפט זה (ראו: רע"א 2401/21 ג'עוני נ' נחלת שמעון בע"מ, פס' 35 לפסק דינו של השופט סולברג וההפניות שם [פורסם בנבו] (1.3.2022)).
אציין כי לגישתי, צמיחתה של "הנאה" כלשהי כתוצאה מהעלאת טענה מסוימת, איננה, ככלל, תנאי לקביעה כי בעל דין מושתק מלטעון את היפוכה. זאת, בעיקרו של דבר, לנוכח רציונל ההשתק שעניינו הגינות ותום-לב, שאינו מתמקד בתוצאת ההליך כי אם בהתנהלות בעל הדין, וממילא, תחולתו אינה מותנית בקיומה של "הנאה" כזו או אחרת (See: Beit Sasson case, at para. 10 of Judge Grunis's ruling, as well as the opinion of Judge Rubinstein; Vinokur case, at para. 13).
לנוכח האמור, אף בהנחה שהייתה מתקבלת טענת המבקש, שלא צמחה לו "הנאה" מהעלאת הטענה האמורה בהליך ההוצאה לפועל, לא היה בכך, לגישתי, כדי להוביל למסקנה שלפיה הוא אינו מושתק מלטעון את היפוכה בהליך דנן.

Judicial silence also applies to appeal proceedings.
בעניין זה קבע כב' השופט מינץ במסגרת ע"א 3381/17 שאול אשכנזי נ' ציון בן שלמה, בין היתר, כך:
וכך כתבתי במסגרת ע"א 7909/16 סיף מתכות בע"מ נ' הממונה האזורי – אגף המכס ומע"מ באר שבע [פורסם בנבו] (26.4.2018):
"הלכה היא כי בעל דין אשר טען טענה משפטית או עובדתית מסוימת, מושתק מלטעון באותו הליך או בהליך אחר טענה הסותרת טענה זו. כלל זה מכונה כלל ההשתק השיפוטי, ותכליתו למנוע פגיעה בטוהר ההליך השיפוטי ובאמון הציבור במערכת המשפט וכן למנוע את ניצולם לרעה של בתי המשפט (ע"א 9056/12 קינג נ' פקיד השומה ירושלים, [פורסם בנבו] פסקה 11 (4.8.2014) (להלן: עניין קינג); רע"א 4224/04 בית ששון בע"מ נ' שיכון עובדים והשקעות בע"מ, פ"ד נט(6) 625 (2005)).
When it comes to claims made at the appeal stage and contradict claims made before the trial court, the rules of judicial estoppel are also embodied in the established rule that the appellate court will not, as a rule, be required to consider a claim that is raised before it for the first time and that changes the face of the hearing. This rule applies even more strongly when it comes to factual claims, and its application is particularly strict when it comes to factual claims that are not only new, but also contradict what was argued before the trial court.

These things are true one by one in this case, as Ashkenazi is currently claiming the opposite of what he claimed in the proceedings that took place in the investigating court and is therefore prevented from doing so….
The relationship between judicial silence and the duty of good faith
When making any claims in court, they should do so in good faith. Lack of good faith יכול להוביל לדחיית טענה, גם אם "משפטית" היא נכונה. הכלל נכון גם ביחס לטענת השתק שיפוטי.
בעניין זה בית המשפט העליון קבע במסגרת רע"א 1604/20 פלוני נ' פלוני, בין היתר, כך:
If this is not enough, then the applicants are silenced from arguing that the respondents' claim should be dismissed due to the lack of permission to divide remedies. This court has often emphasized the duty of a litigant to exercise his legal-procedural powers in an acceptable manner and in good faith, and to act as a decent and reasonable litigant would act in the circumstances of the case. כאשר בעל דין מתכחש בהתדיינות מאוחרת לטענה שטען בהצלחה בהתדיינות קודמת, הרי שהוא נוהג בחוסר תום לב, ועל כן קמה נגדו מניעות, המכונה "השתק שיפוטי", השוללת ממנו את האפשרות לטעון טענות העומדות בסתירה לקו הטיעון המקורי בו בחר (ראו ע"א 513/89 Interlego A/S נ' Exin – Lines Bros S. The rule regarding judicial estoppel may apply when the party's claim in the first proceeding was accepted.
One of the conditions for accepting a claim regarding judicial estoppel is that the party's claim was accepted in the first proceeding.
For example: In the first lawsuit, Yossi claimed that he received one million shekels from Shalom. If the court accepts this claim in the second lawsuit, Yossi will not be able to claim that he only received 500,000 shekels from Shalom.
On the other hand, if Yossi's claim is not accepted, judicial silence will not apply, and he will be able to claim in the second lawsuit that he only received 500,000 shekels from Salam.
בעניין זה בית המשפט העליון קבע במסגרת רע"א 4224/04 בית ששון בע"מ נ' שיכון והשקעות בע"מ, בין היתר, כך:
בפסיקתנו נקבע, בעקבות פסיקה אמריקאית, כי אחד התנאים לקיומו של השתק שיפוטי הינו הצלחה בהליך הקודם (ראו לדוגמה, רע"א 6753/96 מ.מ.ח.ת. בע"מ נ' פרידמן, פ"ד נ(5) 418, 422). In other words, the condition is that the party against whom the judicial immobility is claimed won in the first proceeding based on a claim the opposite of which he claims in the second proceeding. (הכלל מכונה באנגלית Prior success rule, ובלשוננו "כלל ההצלחה הקודמת").
The aforementioned rule stems from the fear that conflicting decisions will be made by two different tribunals (see Boyers, p. 1253). Therefore, if the first court rejected the party's claim, there is no obstacle, in light of the aforementioned rule, for him to raise a contradictory claim in the later proceedings. Of course, when it comes to testimony that contradicts previous testimony, the contradiction will harm the credibility of the witness in the second proceedings, even if no finding was made based on his testimony in the first proceedings. (If a finding is made, another suspension may apply, namely, a group suspension).
I would like to point out that I am not convinced that the requirement of prior success will in every case be an indispensable condition for the application of judicial restraint.However, there is no need to set rules on this issue, since this requirement is met in the present case, as will now be explained.
Please note that at the end of this decision, the court determines that the acceptance of the claim in the previous proceeding will not be relevant for the purpose of claiming judicial estoppel in the later proceeding.

In conclusion
The claim of judicial silence is Legal claim Important and useful, and its purpose is to prevent a litigant, or a party related to him, from making different or opposite claims in two different proceedings.
Judicial silence also applies by virtue of the duty of good faith. The parties must act in good faith towards the court and the opposing party and not abuse legal proceedings, and assert opposite/different claims in different proceedings.
There is a very extensive case law on the issue of judicial silence, and when exactly and under what conditions this claim will apply. It is recommended to familiarize yourself with the relevant Supreme Court case law, because this is a ruling that is binding on other courts.
