The purpose of an award of legal costs in favor of a person whose claims are accepted in any legal proceeding is to compensate the winner for the expenses he incurred throughout the proceeding. That is, the loser pays for the winner's legal expenses.
However, there is no uniformity in the awarding of legal costs at the end of the proceedings or after receiving an interim application, and most judges will not award the winner all the amounts he paid throughout the legal proceedings, but only a partial amount (and sometimes a very low amount). Awarding legal costs at the low threshold is one of the reasons why many plaintiffs feel that justice is not being done in the legal system, because even if the plaintiff wins his claim, sometimes the amount of legal costs he pays (and the time that passes until the verdict is received) is so high that it is questionable whether it was worth filing a lawsuit.
There are several possible situations for receiving legal expenses, which we will discuss now.
Ruling on legal costs after accepting or rejecting an interim application
An interlocutory application is any application filed during the course of any claim (Financial claim, Civil lawsuit, Class action lawsuit, etc.), until the judge issues a ruling. That is, after the ruling, the legal process ends, and after a decision on the interim application, the legal process continues.

Regulation 53 of the Civil Procedure Regulations deals with the issue of legal costs when deciding on an interlocutory application. This regulation states as follows:
At the end of the hearing on each application, the court will rule on the costs of the application and to whom they apply, Regardless of the outcome of the main proceedings, unless he finds that there are special reasons not to charge the said expenses.
That is, according to this regulation, after each decision on an interlocutory application, the judge hearing the claim is supposed to award legal costs in favor of one of the parties (the one whose application was accepted). These costs are independent of the outcome of the proceedings and must be paid within 30 days or another period of time that the court will determine in the decision.
In addition, the judge hearing the claim may not charge one of the parties with costs only if he finds that special reasons exist (i.e., a weighty reason). In practice, most judges do not attribute much significance to this regulation, and one can find countless judicial decisions in which no legal costs were awarded, and the decision does not provide a reason why the court refrained from charging one of the parties with costs.
It is important to note that the more interim requests are filed in a lawsuit, the greater the chance that the court will impose legal costs on one of the parties more times (for example: if 10 interim requests are filed, theoretically, the court may charge one of the parties with legal costs 10 times).

Ruling on legal costs when rendering a verdict
The judgment concludes the legal process and at this point the judge quantifies all the expenses incurred by the plaintiff or defendant (depending on who wins the lawsuit). In order to increase the chance that the court will award all the expenses incurred in favor of the winning party, it should refer to Regulation 155 of the Civil Procedure Regulations, which states:
(A) The court will award legal costs, provided that the litigant has explicitly and in detail specified in his summaries of claims the legal costs as required for the procedure and has attached supporting documents.
(on) The amount of legal expenses will be the sum of all expenses incurred in kind and required for the proceedings as ordered by the court.
(third) The judge who rendered the decision shall order the costs of the trial, unless he is prevented from doing so.

That is, within the framework of the judgment, the judge will address the claims of the winning party in his summary, in which the party must explicitly address the expenses he paid throughout the procedure and for the legal process. The party must also attach references (for example: the party must explicitly address the amount and payment of the court fee, attach tax invoices for payment Lawyer's fees, references to payment to experts or any other expenses paid throughout the procedure).
A litigant who did not request in his briefs to receive reimbursement of legal expenses for a court fee may not receive a refund for the fee, even if the amount of the fee reaches hundreds of thousands of shekels. This is what happened, for example, in the context of verdict בת"א 5881-08-16 משה דוידס נ' אייל יצחק דוידס (פסק דין מיום 10.12.2022):
לאור גובה האגרה, הותרת סעיף 289 לפסק הדין על כנו משמעותה היא שמתוך הסך של 250,000 ₪ שנפסק בגין הוצאות ושכר טרחה (כולל מע"מ) לטובת התובע, סכום של כ-200,000 ₪ מכסה אך ורק את האגרה ששולמה ובהתאם יוצא כי פסקתי לטובת התובע אך ורק סך של 51,118 ₪ בגין שכר טרחה והוצאות אחרות (כולל מע"מ) וסכום זה אינו משקף לעמדתי באופן ריאלי או אף קרוב לכך החזר שכר טרחה שהתובע חויב קרוב לוודאי לשלם לבאי כוחו לצורך ניהול ההליך, וזאת בעיקר בשים לב להיקף ההליך ומורכבותו וסכום הסעד הכספי לו עתר התובע.

The plaintiff in our case did not comply with the requirements of the regulations and in the statement of claim and in the plaintiff's briefs and reply briefs. All that the plaintiff claimed was "להשית על הנתבעים את הוצאות התובע לרבות שכר טרחת עו"ד בצירוף מע"מ כדין", without specifying any specific request regarding the fee, and it may be noted that no reference indicating payment of the fee was attached to the summaries.

Ruling on legal costs for unnecessarily prolonging the proceedings

If the court finds that a party has unnecessarily prolonged the hearing in any proceeding, through frivolous arguments or in any other way, it may, in that proceeding or in the judgment, and regardless of the outcome of the trial, impose on him the costs of the proceeding at a rate it deems appropriate in the circumstances of the case, for the benefit of the opposing party or for the benefit of the State Treasury.
In other words, not only is the court entitled to impose legal costs on a party who unnecessarily delays the investigation of the claim, but the court also has the authority to impose legal costs for the benefit of the state treasury.

Appeal on legal costs
Sometimes a litigant considers filing an appeal on legal costs because he believes that there was no reason to impose costs on him or that the amount of costs imposed on him is unreasonable. Filing an appeal This will not always help.

Awarding actual or partial legal costs

ככלל, יש לפסוק לבעל דין שזכה בהליך הוצאות ריאליות, בכפוף להיותן סבירות, מידתיות והכרחיות לניהול ההליך. שיעור ההוצאות "נקבע תוך בחינת כל מקרה לגופו, תוך התחשבות במספר נתונים, ביניהם: אופן ניהול ההליך; היחס בין הסעד שנתבקש והסעד שנתקבל לבין שיעור ההוצאות; מורכבות התיק וחשיבותו; היקף העבודה שהושקעה על ידי בעל הדין בהליך; ושכר הטרחה ששולם בפועל או שבעל הדין התחייב לשלמו" (רע"א 7650/20 Magic Software Enterprises Ltd נ' פאיירפלאי בע"מ, פסקה 10 והאסמכתאות שם[פורסם בנבו] (28.12.2020)).
Civil Procedure Regulations, התשע"ט-2018 (להלן: התקנות החדשות) מעגנות את הפסיקה בנושא ההוצאות, וקובעות כי אלה נועדו לשפות את בעל הדין שכנגד על הוצאותיו בהליך (תקנה 151(א)), וכי בקביעת שיעורן, על בית המשפט להתחשב, בין היתר, "בשווי הסעד שנפסק וביחס שבינו לבין הסכום שנתבע, בדרך שבה ניהלו בעלי הדין את הדיון, במורכבות ההליך, בהשקעת המשאבים בהכנתו ובניהולו ובסכום ההוצאות שהתבקש" (תקנה 153(ג), וראו בעבר תקנה 511 לתקנות סדר הדין האזרחי, התשמ"ד-1984).
The new regulations convey a message that the default is to award realistic costs. (Along with recognizing situations that justify not charging costs, and see the end of Regulation 152), and the tool of legal costs is one of the tools that the new regulations make available to the court in order to manage the procedure effectively in light of the objectives of the regulations, and to deter the taking of futile or disproportionate procedures (Regulation 4; for ruling on costs according to the new regulations in various types of cases, see the references in Issachar Rosen-Zvi, Reform in the Civil Procedure Code – A Guide for the Perplexed 644 (2021)).
Despite the Supreme Court ruling, in practice, in most cases, the legal costs awarded in the judgments are very far from being realistic legal costs.
