In what cases is a new claim possible?
Filing a new claim is possible in the following cases:
- The court ordered the deletion of the lawsuit due to various omissions on the part of the plaintiff.
- The plaintiff requested that the lawsuit be dismissed on his own initiative.
In this context, it is important to distinguish between Deleting a claim and the dismissal of the claim. In the event that the court orders the dismissal of a claim, a Court actionOnce a judicial act has been created, the same issue cannot be re-examined in a new lawsuit. Even if a new lawsuit is filed on the same issue, even in a different court, the defendant can easily file a new lawsuit. 41. (A) The court may order the deletion of a claim at any time on the basis of one of these grounds:
(1) The statement of claim does not disclose a cause of action;

Resubmitting a lawsuit may constitute an abuse of legal process.

(2) The court may make the deletion of the claim subject to conditions.

סוגיה זו נדונה במסגרת רע"א 30294-05-25 שחר שטרית נ' ראובן גל, שם נקבע, בין היתר, כך:
הוראת תקנה 41(ג)(1) לתקנות, אשר התווספה עת נכנסו לתוקפן תקנות סדר הדין האזרחי החדשות, קובעת כי במקרה בו הורה בית המשפט על מחיקת כתב תביעה – "הדיון בתביעה חדשה יימשך מהשלב שבו נמחקה התביעה הנוכחית, זולת אם הורה בית המשפט אחרת".
הוראה זו, הקובעת ברירת המחדל שלפיה הליך חדש יימשך מהשלב בו נמחק ההליך הקודם, תכליתה "למנוע מתובע שאינו מרוצה ממהלך העניינים בתביעה הראשונה, ומגיע למסקנה שסיכוייו לזכות בתביעה אינם גבוהים, לגרום במחדל לכך שתביעתו תימחק מחמת אי-קיום התקנות או החלטות של בית משפט, על מנת לנסות את מזלו פעם נוספת בעתיד באמצעות הגשת תביעה חדשה באותה העילה" (יששכר רוזן-צבי הרפורמה בסדר הדין האזרחי: מורה נבוכים 300 (מהדורה שלישית, יולי 2025) (להלן: רוזן-צבי)).

Against this background, a plaintiff who files a new claim after his claim has been struck out must file a statement of claim as drafted on the day the previous claim was struck out; and to the extent that he wishes to deviate from this, he must file, alongside the statement of claim, a request to amend it. בענייננו, תביעתו הקודמת של המבקש נמחקה משנמצא כי הוא "מתמיד, באופן שאינו מניח את הדעת, להימנע מלקיים […] החלטה או הוראה של בית המשפט" (תקנה 41(א)(3) לתקנות). כאמור, בית המשפט המחוזי שדן בהליך הקודם קבע בפסק דינו, בהתאם לברירת המחדל הקבועה בתקנה 41(ג)(1) לתקנות, כי ככל שיגיש המבקש תביעה חדשה – זו תימשך מהשלב שבו הופסק ההליך הקודם. חרף האמור, הגיש המבקש כתב תביעה שנוסחו שונה מכתב התביעה שעמד לפני בית המשפט בעת מחיקת ההליך הקודם; וזאת, מבלי שהוגשה כל בקשה לתיקון כתב התביעה.בנסיבות אלה, ניתן היה להורות על מחיקת תביעתו, ולו על יסוד תקנה 41(א)(4) לתקנות, היא "עילת הסל" המסמיכה את בית המשפט להורות על מחיקת כתב התביעה מ"כל נימוק אחר שלפיו הוא סבור שראוי ונכון למחוק את התביעה".
על אף האמור, ראה בית המשפט המחוזי שלא להורות על מחיקת התביעה, אלא לאפשר למבקש להגיש בקשה לתיקון כתב תביעתו. בדרך הילוכו זו, נמנע בית המשפט מלנקוט בצעד הקיצוני של סילוק על הסף, וחלף זאת איפשר למבקש למצות תחילה את האפשרות להגיש בקשה לתיקון כתב טענותיו – בהתאם להלכות המקובלות (ראו: רע"א 3110/23 אביאל נ' דיין, פסקה 14 (18.9.2023); ע"א 3599/94 יופיטר נ' בנק לאומי לישראל בע"מ, פ"ד נ(5) 423, 433 (1997)).
In this context, the applicant's arguments that filing a motion to amend a statement of claim is not necessary or effective must be rejected - since these arguments are inconsistent with the provisions of Regulation 41(c)(1) of the Regulations and its purpose, as detailed; with the manner in which the District Court found to conduct the proceedings, within the scope of the broad procedural discretion granted to it; and not even with the applicant's own arguments in the scope of his response to the motion to dismiss outright. In any case, in light of all the foregoing and particularly in these circumstances, in which the door was not effectively closed to the applicant having his day in court - I did not find it necessary to interfere with the District Court's decision.

In conclusion
Re-filing a claim may be necessary in the event that the court has ordered the deletion of the claim or when the plaintiff has chosen to delete the claim (the considerations for deleting the claim may be different, for example: the plaintiff realized that he had incorrectly drafted the claim and that his chances of winning are low).
Re-filing a claim after it has been struck out is possible because striking out the claim does not create a res judicata. On the other hand, dismissing the claim does create a res judicata, and in such a case, re-filing a claim will in most cases lead to a motion to dismiss on behalf of the defendant. In such a case, the defendant's motion will most likely be granted.
After resubmitting a statement of claim, the procedure will not start again but will continue, usually, from the point where the previous procedure left off.
When resubmitting a statement of claim, the plaintiff must submit the same wording that he submitted in the previous proceeding, and if he chooses to submit a different wording, he must submit a request to amend the statement of claim.
